PANKSHIN SOUTH RERUN: HON. MWANSAT CALEB CLOSES CASE AFTER TENDERING 8 DOCUMENTS AND HON. DASHE OPENS

Hon. Mwansat Istifanus Caleb, has today, closed his case in petition No: EPT/PL/SHA/1/2016, which he filed with his party, the Peoples Democratic Party (PDP), challenging the victory of Hon. Gideon Dashe and the All Progressive Congress (APC).


Before closing his case at the hearing today, Hon. Caleb and the PDP, tendered 8 documents through the bar, which they had earlier applied for from the Independent National Electoral Commission (INEC). These documents include a letter written to the Election Officer in INEC dated 20/2/2016, from one Ogbonna Chijindu.

Under cross examination at the hearing, Hon Mwansat, told the Tribunal that he is aware that he wrote two witness statements, one dated 9th March, 2016 and the additional one on the 4th April, 2016.

He told the Tribunal that he was returned as the winner of the Pankshin South State Constituency election in 2015 because, he scored 9,841 votes, as shown in exhibit 6 before the Tribunal.

With respect to Pyabor polling unit, Hon. Mwnsat stated that when he took his complaint to INEC, he was told that the presiding officer had already written a report, which is exhibit P4.

According to Hon. Caleb, his case partly includes the issue of the Permanent Voting Card (PVC), as he is relying on all the documents tendered.

Under further cross examination, Hon Mwansat said, “it is true that in the election of 2015, Pyabor polling unit was cancelled. The cancellation was because, there were three (3) different results from the polling unit.

“On the day of the rerun election, I did not ask how many voters had their PVCs because, the answer has already been provided for at the stakeholders meeting we had with INEC on 10th February, 2016. I also know that registration of voters and continuous distribution of PVCs is within a time frame before any election.

“I did not participate in the distribution of PVCs and I am not a registered voter in Pyabor polling unit.”

Although Hon. Gideon Dashe opened his case immediately Hon. Caleb closed his, however, owing to hitches of making his key witnesses available, the matter has been adjourned to 3rd May, 2016 for further hearing on the petition.
