JUST IN: PLATEAU: COURT STRIKES OUT SUIT NO. PLD/J/108/2015 FILED BY KAMULA NIG. LTD AND HON. LAWAL ADAMU, AGAINST MALLAM NASIRU MUSTAPHA AND RIKKOS COMMUNITY DEVELOPMENT FORUM

Plateau State High Court has struck out suit No. PLD/J/108/2015 filed by Kamula Nig. Ltd and its Director and Chief Executive Officer (CEO), Hon. Lawal Adamu, against Mallam Nasiru Mustapha and Rikkos Community Development Forum for want of diligent prosecution.


You would recall that the Plateau State High Court presided over by Hon. Justice Dakwak, had adjourned the matter to today 14/07/2017, for definite hearing. But, the Plaintiffs (Kamula Nig Ltd and Hon. Lawal Adamu) and their Counsel were not present in Court.
 
Although REALITY gathered that the Counsel had written a letter to the Court explaining that his absence was on the ground of health challenges, the Court was moved to strike out the case, based on the submissions of the Defendants’ Counsel, Ahmed S. Garba (Esq) of A. S. Garba & Co.  


Garba (Esq), had submitted that though he sympathizes with his colleague, over his health challenges, as contained in the letter, but that the circumstance created by the letter does not cover for other lawyers in the chambers that are conversant with the case.

Garba (Esq), argued that the letter did not explain of their whereabouts and why they were not in Court.
He said, “this matter is not handled with the required diligent that is required.  

Adding that, “even the signatory to the letter has been coming to Court and he is conversant with the matter”.
He therefore, urged the Court to strike out the suit.

Other defendants in the suit were, Alhaji Inuwa Adamu, Isa Ibrahim, Ahmad Adamu Baba, Adam Tanimu, Ismaila Sanni, Abdullahi Balarabe and Alhaji Muhammed Hassan, who were sued in their personal capacities and on behalf of the name and style of Rikkos Community Development Forum.
