PDP vs PLASIEC: DISMISS PLASIEC’S PRELIMINARY OBJECTION (PO), IN SUIT NO. PLD/J250/2021, FOR BEING TOXIC. PWAJOK (SAN) TELLS COURT

As the Plateau State High Court resumes today, the Peoples Democratic Party (PDP) has asked the Court, presided over by Hon. Justice I. Kunda, to dismiss the Notice of Preliminary Objection (PO) filed by the Plateau State Independent Electoral Commission (PLASIEC) in Suit No.  PLD/J250/2021, which is a response to its Originating Summons filed on the 6^th of July, 2021, for being allegedly toxic.

This line of objection came when the Counsel to PLASIEC, G. S Pwul (SAN), request to withdraw the PO and asked the Court to strike out same.

In his vehement objection to the application, Counsel to the PDP, Edward Pwajok (SAN), leading S. G. Odey (Esq), S Oyawole (Esq) and other Lawyers, described the PO as toxic and vexatious and that, “the best the Court can do to it is dismiss the PO”.

However, owing to the authorities cited by, Pwajok (SAN) in urging the Court to out rightly dismiss the PO, the Court has adjourned the matter to tomorrow, 11am, to enable the Counsel to PLASIEC respond.

Speaking to the media in an ‘on-the-spot’ interview, Pwajok (SAN), explained that, the application was coming after issues have been joined by parties and that it is an attempting to seek for an adjournment through the backdoor.

He said, “The application is also an attempt to correct their earlier processes that ran in violation to the rules of Court, a process that, had 28 pages written address instead of the 20 pages allowed by rules of Court”.

“I don’t know why PLASIEC is acting as if it is a political party. Must they win everything and everywhere?” Pwajok (SA) questioned.

In a different development, the same Court, presided over by Hon. Justice Kunda has adjourned suit No. PLD/J249/2021, for judgment, ant to a date yet to be announced.

The adjournment came, after the Court had listened to Pwajok (SAN), Counsel to the PDP move the Originating Summons, dated 6^th July and filed same day and Garba Pwul move the Counter Affidavit of PLASIEC in objecting to the Originating Summons.

“Before the Court is an Originating Summons, dated and filed on the 6^th of July, 2021.

“The Originating Summons has questions for determination with an affidavit also filed. Attached are exhibits with an accompanied written address. We rely on all the paragraphs of the affidavit and we also adopt the said address”. Pwajok (SAN) tells the Court, while moving PDP’s case.
