The matter between the Peoples Democratic Party (PDP) against the Plateau State Independent Electoral Commission (PLASIEC) was adjourned to yesterday, the 11th of August, 2021, to hear the Motion on Notice challenging the Court’s Jurisdiction to sit on the matter during Court vacation filed by the Defendant PLASIEC.
The business of the Court yesterday therefore was to hear arguments and submissions against or in support of the Motion, as the parties are expected to have filed their processes and must have served Counsel to Counsel, as ordered by the court, as requested by the Counsels. G. S. Pwul (SAN) explained.
During the hearing yesterday, Edward Pwajok (SAN), the Counsel for the PDP, made an oral Application for all the Motions, Applications and the Substantive Suit to be moved, to checkmate the possible perceived intention of the Defendant, PLASIEC plan to go ahead with the Local Government (LG) elections, as scheduled and in the process exclude the Plaintiffs (PDP).
But, G. S. Pwul (SAN), objected to the Application. He told the Court that, the Plaintiff would lose nothing even if, the elections were conducted without them (Plaintiff) participating.
He submitted that, “If the Court later rule against the Defendant (PLASIEC) on the Motions and Applications, the PDP can always reap from where they did not sow. Citing the case of Zamfara State and therefore, urging the Court to hear and rule on the Motions challenging the Jurisdiction of the Court to sit on vacation separately.
After hearing the submissions of all parties on the Motion on Notice, in the ruling of the Court, Hon Justice I. Kunda, said, the application of the PDP was to seek direction from the Court. But held that, the Motion challenging his jurisdiction to sit on the suit of the Plaintiff must be treated first, as it is very fundamental. Else, whatever that is done would be a nullity and futile.
The Court has adjourned the matter to the 20/08/2021 for ruling on the Motion on Notice.
